ORDER


AND NOW, this 17th day of February, 2005, upon consideration of petitioner's motion for reconsideration and/or filing of appeal nunc pro tunc, and the court's order denying petitioner's habeas corpus petition under 28 U.S.C. § 2254 having been filed on May 18, 2004 and the motion and appeal having been filed on January 12, 2005, IT IS HEREBY ORDERED that:

1. Petitioner's motion for reconsideration is DENIED in that it relies on a traverse and objections which were raised and considered by the court at the time of its entry of the order and is untimely. See Local Rule of Civil Procedure 7.1(g).

2. Petitioner's motion for filing of appeal nunc pro tunc is DENIED as untimely. See Fed.R.App.P. 4(a)(1)(5)(6).
