This case is on the calendar of the Court's November 13, 2023, trial session for Houston, Texas. On October 20, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution.

Upon due consideration, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, is set for hearing at the calendar call of the aforementioned session of the Court, at 10:00 AM (Central Time). Petitioner is advised that failure to comply with the terms of this Order or failure to appear at the hearing on November 13, 2023, may result in the Court granting respondent's motion and entering an order and decision against petitioner.
