Petition for Review

ORDER

This matter is before the court on Petitioner Leslie Orellana-Amaya's Unopposed Motion to Dismiss Without Prejudice, by which she seeks to voluntarily dismiss this petition for review without prejudice pursuant to Fed. R. App. P. 42(b).

On May 24, 2020, this court entered an order informing Petitioner that the court will not dismiss a petition for review without prejudice under Federal Rule of Appellate Procedure 42(b), and directed Petitioner to, on or before June 1, 2021, file a supplement to the motion stating any objection or non-objection to voluntary dismissal of this petition for review with prejudice. The court further indicated that it would deem a non-response as an understanding that voluntarily dismissal is with prejudice, and grant Petitioner's motion for voluntary dismissal pursuant to Rule 42(b).

Petitioner has not filed a supplement to the motion. Accordingly, the motion is granted as modified herein. The court dismisses this petition for review with prejudice. See Fed. R. App. P. 42(b); 10th Cir. R. 27.5(A)(9).

A copy of this order shall stand as and for the mandate of the court.
