WRIT DENIED. In accordance with La. Code Civil P. art. 966(D)(1) and Babin v. Winn-Dixie Louisiana, Inc., 2000-0078 (La. 6/30/00), 764 So.2d 37(per curiam), the plaintiff has produced sufficient evidence to establish the existence of a genuine issue of material fact.
