Onyx Fin. Group v. the World Travel

District Court of Appeal of Florida, Third District
Jul 26, 1995
657 So. 2d 972 (Fla. Dist. Ct. App. 1995)

Opinion

No. 93-1777.

July 26, 1995.

An appeal from the Circuit Court for Dade County; Herbert M. Klein, Judge.

Richard B. Marx, Coconut Grove, for appellants.

Jeanne Heyward, Miami, John Kirk McDonald, Coral Gables, for appellee.

Before NESBITT, JORGENSON and GREEN, JJ.

The trial court's denial of appellant's motion to set default, relief from final judgment and other relief was not an abuse of discretion where the record fails to disclose any excusable neglect either by appellants or their attorney and where the trial court properly amended the final judgment to reflect the partial payment made by appellants.

Affirmed.
