Motion to dismiss appeal denied on condition that within five days from the date of the order herein the appellant pay to respondents' attorney ten dollars costs, and that the appeal be perfected for the December term (for which term the case is set down) and be ready for argument when reached; otherwise, motion granted, with ten dollars costs.
