Respondent having moved for an extension of time to file and serve a brief on the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on September 11, 2012, and appellant having cross-moved for an extension of time to file and serve a reply brief on the order entered September 11, 2012,
Now, upon reading and filing the affirmation of John G. Powers, Esq., dated December 19, 2012, the affidavit of W. Bradley Hunt, Esq., sworn to January 2, 2013, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to file and serve a respondent's brief is granted on the condition that the brief is filed and served on or before February 15, 2013, and the Clerk is directed to accept the brief for filing, and
It is further ORDERED that the cross motion is granted insofar as it seeks an extension of time to file and serve a reply brief on the condition that the reply brief is filed and served on or before March 8, 2013.
