ON CALL PSYCHIATRIC SERVICES, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

This case is on the calendar of the Court's April 3, 2023 trial session for San Francisco, California. On March 10, 2023, petitioner filed a Motion for Entry of Decision. By Order dated March 14, the Court ordered a hearing.
On March 15, petitioner filed a Motion for Continuance. In that motion, petitioner's counsel reported that after the filing of the Motion for Entry of Decision, he and respondent's counsel spoke, resolved their misunderstanding, and agreed to a communication protocol through which they will work together toward resolution of the case. Further, the motion states that petitioner will withdraw their Motion for Entry of Decision. Petitioner asks the Court to continue the case generally and represents that respondent does not object to the granting of the motion.
In light of the foregoing, it is
ORDERED that petitioner's Motion for Continuance, filed March 15, 2023, is recharacterized as "Motion for Continuance and to Withdraw Motion for Entry of Decision". It is further
ORDERED that petitioner's Motion for Continuance and to Withdraw Motion for Entry of Decision is granted. The Motion for Entry of Decision, filed March 10, 2023, is withdrawn and is stricken for hearing from the Court's April 3, 2023, San Francisco, California, trial session. It is further
ORDERED that this case is stricken from the aforementioned trial session. The parties are excused from appearing at the calendar call on April 3, 2023, and this case is restored to the general docket.
