This case is on the calendar of the Court's April 3, 2023 trial session for San Francisco, California. On March 10, 2023, petitioner filed a Motion to Dismiss for Lack of Prosecution. Therein, petitioner represents its belief that the case is susceptible to settlement and has communicated the same to respondent, but has not heard from respondent in more than a year. Petitioner further represents that respondent's counsel has not responded to telephone calls or correspondence from its counsel.

Upon due consideration, it is

ORDERED that petitioner's Motion to Dismiss for Lack of Prosecution is recharacterized as petitioner's Motion for Entry of Decision. It is further

ORDERED that on or before March 28, 2023, respondent shall file an objection or response to the Motion. It is further

ORDERED that the Motion is set for hearing at the calendar call of the aforementioned session of the Court, at 10:00 AM (PT). Respondent is advised that failure to comply with the terms of this Order or failure to appear at the hearing on April 3, 2023, may result in the Court granting petitioner's motion and entering an order and decision in favor of petitioner.

This Order constitutes official notice to the parties.
