An appeal having been taken to this Court from the order of the Supreme Court, New York County, entered on or about January 22, 2016,And defendant-intervenor-appellant Commerce Court having moved for an enlargement of time to perfect the appeal (M-5761), And defendants-respondents 160 Chambers Street Owners, Inc., et al. having cross-moved for dismissal of the aforesaid appeal (M-6153), Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon, It is ordered that the motion (M-5761) is granted to the extent of enlarging the time to perfect the appeal to the September 2017 Term. The cross motion (M-6153) is granted unless the appeal is perfected for said September 2017 Term.
