309 A.D.2d 841 (N.Y. App. Div. 2003)

Opinion

2002-04725

Argued September 11, 2003

October 20, 2003.

In an action to recover damages for personal injuries, etc., the plaintiffs appeal from a judgment of the Supreme Court, Kings County (Dabiri, J.), entered April 30, 2002, which, upon a jury verdict, is in favor of the defendant and against them, dismissing the complaint.

DiJoseph Portegello, P.C., New York, N.Y. (Arnold E. DiJoseph III of counsel), for appellants.

Isserlis Sullivan, New York, N.Y. (London Fischer LLP [John J. Peplinski] and Myra Needleman of counsel), for respondent.

MYRIAM J. ALTMAN, J.P. GABRIEL M. KRAUSMAN GLORIA GOLDSTEIN DANIEL F. LUCIANO, JJ.

DECISION ORDER

ORDERED that the judgment is affirmed, with costs.

Under the circumstances of this case, the Supreme Court properly restricted the testimony of the plaintiffs' expert ( see Novikova v. Greenbriar Owners Corp., 258 A.D.2d 149).

The plaintiffs remaining contention does not require reversal.

ALTMAN, J.P., KRAUSMAN, GOLDSTEIN and LUCIANO, JJ., concur.
