Michael O'LOUGHLIN, Petitioner, v. STATE of Florida, Respondent.

Michael O'Loughlin, pro se, Petitioner.

Ashley Moody, Attorney General, and Trisha Meggs Pate, Bureau Chief, Tallahassee, for Respondent.

Per Curiam.

As there is no motion pending before the lower tribunal, the petition for writ of mandamus is denied. This disposition is without prejudice to petitioner refiling a date-stamped copy of his motion to correct illegal sentence in the lower tribunal. See Clark v. State , 954 So. 2d 685 (Fla. 1st DCA 2007).

Roberts, Makar, and M.K. Thomas, JJ., concur.
