The issues of both fact and law presented in this case are not different from those presented in Merrett v. Shreveport Municipal Fire and Police Civil Service Board, La. App., 72 So.2d 519, this day decided. Our findings therein are decisive in the instant case.

The judgment from which appealed is reversed and set aside, and plaintiff's demands are rejected at his cost.
