BRANDIE OLIVAREZ, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the Criminal District Court No. 4 Dallas County, Texas Trial Court Cause No. F19-14122-K

ORDER

ROBERT D. BURNS, III CHIEF JUSTICE.

We REINSTATE this appeal.

On November 28, 2023, we abated this case for the trial court to hold a hearing and make findings concerning the plea agreement leading to the March 6, 2020 Order of Deferred Adjudication. The trial court held the hearing on May 17, 2024. The court reporter filed the reporter's record of that hearing on May 30, 2024. At the hearing, the assistant district attorney stated, "I've spoken with Defense. I believe we're both in agreement that this [State's Exhibit A] is what the plea agreement form would have looked like. I will offer State's Exhibit A." Appellant's attorney at the March 6, 2020 plea hearing told the trial court he had no objection to the exhibit. Appellant's appellate attorney asked appellant, "Do you have any problems with this?" and appellant answered, "No." The trial court admitted the exhibit into evidence. The plea agreement is State's exhibit A to the reporter's record of the May 17, 2024 hearing. We conclude the record for this appeal is now complete.

Appellant's brief is due JULY 1, 2024.
