Before us is appellant's February 15, 2024 fifth motion for extension of time to file his brief and alternatively appellant's motion to abate this case to the trial court. We GRANT appellant's fifth motion to extend time to file his brief and order appellant's brief due on or before MARCH 5, 2024. We DENY appellant's motion to abate this case to the trial court. If appellant's brief is not filed by that date, this appeal will be abated for the trial court to make findings in accordance with rule of appellate procedure 38.8. See Tex. R. App. P. 38.8(b)(2).
