Before this Court is appellant's October 23, 2023 motion for extension of time to file appellant's brief. In his motion, appellant points out that in case 05-21-00624-CR (trial court cause no. F19-14122-K) the clerk's record does not contain the plea agreement from the original plea. Accordingly, we ORDER the Dallas County District Clerk to file, within FIFTEEN DAYS of the date of this order, a supplemental clerk's record containing the plea agreement papers in cause no. 05-21-00624-CR (trial court cause no. F19-14122-K).
In the event the Dallas County District Clerk does not have in its possession the plea paperwork, we ORDER the Dallas County District Clerk to file, within FIFTEEN DAYS of the date of this order, a letter verifying that the clerk does not have possession of the plea paperwork.
Appellant's brief is due THIRTY DAYS after the District Clerk files the supplemental record or a letter verifying that the Clerk does not have possession of the plea paperwork.
We DIRECT the Clerk to send copies of this order, by electronic transmission, to Felicia Pitre, Dallas County District Clerk; and to counsel for all parties.
