Oliva v. State

District Court of Appeal of Florida, First District
Aug 30, 2000
766 So. 2d 439 (Fla. Dist. Ct. App. 2000)

Opinion

No. 1D00-2185.

Opinion filed August 30, 2000.

An appeal from the Circuit Court for Leon County; L. Ralph Smith, Jr., Judge.

D. Michael Campbell of Campbell Associates, Miami, Elizabeth Russo, of Russo Appellate Firm, Miami, and Murray M. Wadsworth of Wadsworth Davis, Tallahassee, for the Appellant.

Robert A. Butterworth, Attorney General, Louis F. Hubener, Assistant Attorney General, and James, A. Peters, Special Counsel, Tallahassee, for the Appellees.

An order merely granting a motion to dismiss is not an appealable, non-final order or a final order. See Benton v. Moore, 655 So.2d 1272 (Fla. 1st DCA 1995). As such, this appeal is dismissed without prejudice for lack of jurisdiction.

WOLF, DAVIS, and VAN NORTWICK, JJ., CONCUR.
