OPINION

On September 6, 2006 the London Underwriter defendants moved for judgment as a matter of law or, in the alternative, for a new trial in connection with the Geigy/Route 211 site.

There have been various proceedings regarding Geigy/Route 211, reflected in a stipulation dated August 24, 2007 and an order dated August 28, 2007.

In view of this stipulation and order, the motion filed September 6, 2006 is denied, and further proceedings regarding Geigy/Route 211 will take place according to the stipulation and order.

SO ORDERED.
