OPINION


London Market Underwriters have moved for judgment as a matter of law regarding the Niagara Falls sites, based on the recent Court of Appeals opinion. It is the view of the court that it is necessary to have a new trial with factual questions presented to the jury, in accordance with the rules laid down by the Court of Appeals. This has been the subject of extensive discussions with counsel. No further elaboration is necessary.

The motion for judgment as a matter of law is denied.
