ORDER

Appellant Rebecca Ann Oldaker appealed the trial court's judgment and sentence of July 20, 2023. On January 20, 2024, she filed her brief, challenging only the trial court's assessed costs. In response, the State of Texas filed an Unopposed Motion for Limited and Temporary Abatement to Trial Court asking "this [C]ourt to abate this appeal for a period of seven days to (1) provide the State an opportunity to file a motion for the trial court to waive the assessment of the challenged court costs, and (2) provide the trial court an opportunity to consider and rule on the motion."

The State's motion is granted. The appeal is abated, treated as a closed case, and removed from this Court's active docket.

The parties are ORDERED to submit a status report within fifteen days from the date of this order, informing the Court of the trial court's ruling. If the parties do not file a status report by that date, the Court will assume the case was not heard by the trial court or the trial court denied the State's motion, and will, therefore, lift the abatement and reinstate the case to its active docket.

It is so ORDERED.
