And respondent-appellant, pro se, having moved, pursuant to CPLR 1101 and 1102, for leave to prosecute the appeal as a poor person, for assignment of counsel, a free copy of the transcript, and for related relief (Motion No. 2023-00390), And Sarah Bovill, Esq., The Children's Law Center, attorney for the subject children and petitioner-respondent having separately moved to dismiss the appeal as taken from an interim order of the Family Court and without leave to appeal (Motion No. 2023-00759 and Motion No. 2023-00779), Now, upon reading and filing the papers with respect to the motions and due deliberation having been had thereon, It is ordered that the subject children's motion to dismiss the appeal is granted, and the appeal is deemed dismissed (Motion No. 2023-00759); and
It is further ordered that respondent-appellant's motion to prosecute the appeal as a poor person (Motion No. 2023-00390) and petitioner-respondent's motion to dismiss the appeal (Motion No. 2023-00779) are both denied as academic.
