This case was calendared for trial at the Court's Dallas, Texas trial session, which was scheduled to begin February 21, 2023. On January 23, 2023, respondent made a Motion to Dismiss for Failure to Properly Prosecute. On January 27, 2023, the Court served an Order to Show Cause on petitioner instructing him to on or before February 17, 2023, show cause in writing why respondent's Motion to Dismiss for Failure to Properly Prosecute filed January 23, 2023, should not be granted and a decision entered against petitioner for the amounts and year set forth in respondent's Motion. On February 21, 2023, this case was called, both petitioner and respondent's counsel appeared and were heard. At that time both respondent and petitioner made an Oral Motion for Continuance so that petitioner could have more time to work with pro bono attorneys.
Upon due consideration and for cause more fully appearing in the transcript, it is hereby
ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute filed January 23, 2023, is denied. It is further
ORDERED that the Courts Order to Show Cause served January 27, 2023, is discharged. It is further
ORDERED that, on or before April 24, 2023, the parties shall submit to the Court either a stipulated decision or file a joint report (or separate reports, if preferred) regarding the then-present status of this case. It is further
ORDERED that this case is continued. It is further
ORDERED that jurisdiction is retained by the undersigned.
