876 So. 2d 743 (Fla. Dist. Ct. App. 2004)

Opinion

Case No. 4D04-2684.

Opinion filed July 19, 2004.

Petition for writ of habeas corpus to the Circuit Court for the Seventeenth Judicial Circuit, Broward County, Stanton S. Kaplan, Judge, L.T. Case No. 04-10953 CF10A.

H. Frank Rubio and Rodney W. Bryson, Miami, for petitioner.

Charles J. Crist, Jr., Attorney General, Tallahassee, and Joseph A. Tringali, Assistant Attorney General, West Palm Beach, for respondent.

CORRECTED OPINION

We grant petitioner's petition for writ of habeas corpus. He is being detained without bond, by order of the court, until the completion of a psychological evaluation. The respondent has provided us with no reason for properly detaining petitioner further under this order, and we accordingly grant the petition and order his immediate release.

FARMER, C.J., STONE and KLEIN, JJ., concur.
