DECISION & ORDER ON MOTION

On the Court's own motion, it is

ORDERED that the order to show cause of this Court dated June 2, 2023, in the above-entitled case is recalled and vacated, and the following order to show cause is substituted therefor:

Appeal and cross appeal from an order of the Supreme Court, Rockland County, dated March 10, 2020, and appeal from an order of the same court dated July 14, 2022. Motion by the respondent-appellant to consolidate the appeals or, in the alternative, to calendar the appeals together. Application by the appellant to extend the time to perfect the appeal from the order dated July 14, 2022.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion, the parties to the appeal are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeals and cross appeal on the ground that the right of direct appeal from the orders terminated upon entry in the above-entitled action of a judgment of the Supreme Court, Rockland County, dated October 7, 2022 (see Matter of Aho, 39 N.Y.2d 241), by uploading a digital copy of an affirmation or an affidavit on that issue, via NYSCEF, on or before July 21, 2023; if the parties be so advised, the parties may make a motion, via NYSCEF, on or before July 21, 2023, for any relief deemed appropriate; and it is further, ORDERED that the motion and the application are held in abeyance in the interim;

ORDERED that the Clerk of the Court, or her designee, shall serve a copy of this order to show cause upon the parties to the appeals and cross appeal by uploading a copy of this order to show cause to the NYSCEF system.
