ORDER OF SUSPENSION

Upon consideration of the Office of Disciplinary Counsel's petition for the immediate suspension of Respondent Jon H. Magarifuji from the practice of law for failure to cooperate with a disciplinary investigation, the memorandum and exhibits in support thereof, the record, and Respondent Magarifuji's response to our November 7, 2003 notice and order to appear and show cause this court concluded Respondent Magarifuji had failed to cooperate with the disciplinary investigation, but granted Respondent Magarifuji twenty (20) calendar days to fully comply with Disciplinary Counsel's requests. Our December 15, 2003 order specifically notified Respondent Magarifuji that failure to fully comply with Disciplinary Counsel's requests would result in immediate suspension. By letter dated January 5, 2003, Assistant Disciplinary Counsel advises that Respondent Magarifuji has not responded to requests for information and documents. Therefore,

IT IS HEREBY ORDERED, pursuant to Rule 2.12A of the Rules of the Supreme Court of the State of Hawai`i, that Respondent Jon H. Magarifuji is suspended from the practice of law in this jurisdiction. This order is effective immediately and until further order of this court.
