ORDER OF SUSPENSION, (ODC 01-260-7004).


Upon consideration of the Disciplinary Board's Report and Recommendation for the suspension of James C. Beaman for two years and the record, it appears that Respondent Beaman failed to provide competent representation to a client, failed to act with reasonable diligence and promptness in representing a client, failed to keep the client reasonably informed about the status of a matter, and failed to expedite litigation consistent with the interests of the client in violation of Rules 1.1, 1.3, 1.4(a) and (b), 1.16(a)(1) and (d), 3.2, 3.4(e), 8.1(b), and 8.4(a) and (d) of the Hawai`i Rules of Professional Conduct. It further appears that Respondent Beaman is currently suspended, pursuant to Rule 2.12A of the Rules of the Supreme Court of the State of Hawai`i ("RSCH"), and making discipline effective thirty (30) days after entry of this order, see RSCH 2.16(c), would be pointless. See Office of Disciplinary Counsel v. DeMello, 61 Haw. 223, 225, 601 P.2d 1087, 1088 (1979). Therefore,

IT IS HEREBY ORDERED that Respondent James C. Beaman is suspended from the practice of law in this jurisdiction for a period of two years, effective immediately.

IT IS FURTHER ORDERED that, as a condition of his reinstatement, Respondent Beaman must take the professionalism course offered pursuant to RSCH 1.14. See RSCH 2.3(d). Respondent Beaman shall also reimburse the Disciplinary Board for the costs associated with this proceeding, as determined by this court after timely submission of a bill of costs.

IT IS FINALLY ORDERED that Respondent Beaman shall, within ten (10) days after the effective date of the suspension order, file with this court an affidavit in full compliance with RSCH 2.16(d).
