PRESENT:

Respondent having moved for permission to proceed as a poor person and assignment of counsel on the appeal taken herein from an order of the Wayne County Surrogate's Court entered in the Office of the Clerk of said court on June 4, 2015,

Now, upon reading and filing the affirmation of Victor B. Chambers, Esq., dated January 26, 2016, the affidavit of Mark A. Burris sworn to January 19, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion for permission to proceed as a poor person is granted, and the motion is otherwise denied.
