In Re: Melissa O'Dwyer, Laura Franks, Jiala Barclay, Rachel Carraway, Mark Bates, Tamika Thomas-Magee and Anavernyel Neyuland-Pryan, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 604436. BEFORE: PETTIGREW, McDONALD AND PENZATO, JJ.
WRIT GRANTED IN PART AND DENIED IN PART. The trial court's October 5, 2016 order addresses the preparation and cost estimate of the master appellate record of Ms. O'Dwyer's claim. However, the order fails to address the appellate records of the six remaining plaintiffs and the estimate of the costs in each of those appeals. Accordingly, the writ is granted in part and the trial court is instructed to order the East Baton Rouge Parish Clerk of Court to prepare an estimate of costs of each of those six appellate records based only on the particular documents necessary to those appeals, as instructed in the Louisiana Supreme Court's August 27, 2015 order. O'Dwyer v. Our Lady of Lake Nurse Anesthesia Program ex rel. Our Lady of Lake College, 2015-1593 (La. 8/27/15), 174 So.3d 1155. The writ is denied in part as to that portion of plaintiffs' application seeking review of a ruling denying their motion to recuse the trial judge. Review of a ruling in a separate judgment must be sought in a separate, timely filed writ application. We note that based on the documentation received by this Court, any such filing would now be untimely. See Uniform Rules of Louisiana Courts of Appeal, Rule 4-3.
