DECISION AND ORDER ON MOTION

Motion to dispense with stipulation.

Upon the papers filed in support of the motion and the cross motion and the papers filed in opposition thereto, it is

ORDERED that the motion to dispense with stipulation is denied, without costs, and it is further

ORDERED that the cross motion to dismiss the appeals is granted, without costs, only to the extent that the appeal from the decision and order entered February 21, 2012 is dismissed, and it is further

ORDERED that the cross motion to dismiss the appeal from the order entered July 26, 2012 is denied, without costs, and without prejudice to the issue being raised upon argument of the appeal.
