Odell v. Odell

Appellate Division of the Supreme Court of New York, Second Department
Mar 20, 1950
276 App. Div. 1027 (N.Y. App. Div. 1950)

Opinion

March 20, 1950.

The order appealed from increases alimony fixed in a final judgment of divorce from $50 to $60 a week. Plaintiff appeals from so much of the order as fails to grant her application to increase her alimony to the sum of $100 per week. Order, insofar as appealed from, modified on the facts by striking from the ordering paragraph the words "Sixty Dollars per week" and by substituting in lieu thereof the words "Seventy-five Dollars per week". As so modified, the order is affirmed, with $10 costs and disbursements to appellant. In the light of all the factors which are presented, an increase of alimony to the sum of $75 per week is warranted. Carswell, Acting P.J., Johnston, Sneed, Wenzel and MacCrate, JJ., concur.
