IT IS ORDERED AND ADJUDGED, that this action is dismissed pursuant to the Decision and Order dated November 17, 2023 of Senior Judge Thomas J. McAvoy which ORDERED that the amended complaint is accepted for filing; ORDERED that plaintiff's claims are DISMISSED without prejudice pursuant to 28 U.S.C. § 1915(e)(2)(B) and 28 U.S.C. § 1915A(b)(1) for failure to state a claim upon which relief may be granted; and ORDERED that the Clerk is directed to close this case.
