An appeal having been taken herein from an order of the Supreme Court, Niagara County, entered in the Office of the Clerk of said Court on June 15, 2011, and petitioner-respondent having moved for an extension of time within which to file and serve his brief,

Now, upon reading and filing the affidavit of Thomas J. Caserta, Jr., Esq., sworn to May 14, 2012, the notice of motion with proof of service thereof, and the statement of Leonard G. Tilney, Jr., Esq., dated May 16, 2012, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted on condition that petitioner-respondent submit ten copies of his brief to the Court, together with proof of service, on or before July 2, 2012, and the Clerk is directed to accept said briefs for filing.
