ORDER

This case was called and recalled from the calendar of the Court's May 15, 2023, New York City, New York, trial session. Petitioner and counsel for respondent appeared and were heard.

On April 24, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. On May 9, 2023, petitioner filed a Motion for Leave to File Motion to Seal and lodged a Motion to Seal. Subsequently, petitioner filed on May 12, 2023, a Motion for Continuance.

Upon due consideration and for cause more fully appearing on the transcript of the proceedings, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed April 24, 2023, is denied as moot. It is further

ORDERED that petitioner's Motion for Leave to File Motion to Seal, filed May 9, 2023, is granted. It is further

ORDERED that petitioner's Motion to Seal, lodged May 9, 2023, is granted and filed as of the date of this order. Petitioner's Response to Motion to Dismiss for Lack of Prosecution filed May 5, 2023, as docket entry 28, is hereby sealed. It is further

ORDERED that petitioner's Motion for Continuance, filed May 12, 2023, is granted and this case is continued and restored to the general docket.
