Supreme Court of Delaware
Jan 11, 2006
889 A.2d 283 (Del. 2006)

Opinion

No. 439, 2005.

January 11, 2006.

Family Court of the State of Delaware, in and for New Castle County, File No. CN03-06351.

ORDER

This 11th day of January 2006, it appears to the Court that, on December 5, 2005, the Clerk issued a notice to appellant to show cause why this appeal should not be dismissed pursuant to Supreme Court Rule 29(b) for her failure to diligently prosecute his appeal by not complying with the Court's directive dated November 9, 2005 regarding her payment of fees and costs. The appellant has failed to respond to the notice to show cause within the required ten-day period; therefore, dismissal of this action is deemed to be unopposed.

NOW, THEREFORE, IT IS HEREBY ORDERED, pursuant to Supreme Court Rules 3(b) and 29(b), that the within appeal is DISMISSED.
