Ocala Eye Surgeons v. Ocala Nissan

District Court of Appeal of Florida, First District
Feb 14, 1991
574 So. 2d 305 (Fla. Dist. Ct. App. 1991)

Opinion

No. 90-252.

February 14, 1991.

An Appeal from an order of the Judge of Compensation Claims, Elwyn M. Akins.

Dorothy Clay Sims, of Sims DiLorenzo, Ocala, and Joseph C. Segor, Miami, for appellant.

Valerie A. Marshall and J. Larry Hanks, of Jeffery, Thomas Marshall, P.A., Maitland, for appellees.

The record contains competent, substantial evidence to support the judge's finding that the employer/carrier did not receive the physician's bill or have knowledge thereof until May 5, 1989. We therefore AFFIRM the order denying appellant's claim for bad faith attorney's fees and costs.

NIMMONS and ZEHMER, JJ., concur.
