On September 30, 2024, respondent filed two motions to dismiss for lack of prosecution. These motions appear to be duplicates, however one of the motion at index no. 17 is missing an exhibit. Premises considered, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed September 30, 2024, at index no. 17, is hereby stricken from the record in this case. It is further

ORDERED that petitioner shall, on or before October 15, 2024, file with the Court a response or objection to respondent's Motion to Dismiss for Lack of Prosecution, filed September 30, 2024, at index no. 18.

Petitioner is advised that failure to respond to respondent's motion and/or failure to appear at the calendar call on October 21, 2024 at 1 p.m. (ET) and meaningfully participate in the prosecution of this case, may result in the granting of respondent's aforementioned motion and a decision entered against petitioner in accordance with that motion.
