Appeal from Supreme Court, Madison County.

Present — Hill, P.J., Bliss, Heffernan, Schenck and Foster, JJ.


The action is for damages for the conscious pain and suffering and death of plaintiff's intestate, resulting from an intersection collision between an automobile in which he was a passenger and a motor tractor-trailer of the defendant. Judgment and orders unanimously affirmed with costs on appeal from the judgment only.
