The order (designated as a "judgment") entered April 27, 1988, is to be modified by redesignating it as a partial summary judgment for the commission on count IV of the amended complaint, by vacating the preliminary injunction entered March 3, 1983, and by stating that, to the extent that the commission's motion for summary judgment may be read as having sought remand to the commission of counts I, II, and III of the complaint, it is denied. As so modified, the order is affirmed.
