Appellant's brief in this case is overdue, and the appeal is subject to dismissal for want of prosecution. By letter dated April 12, 2024, appellant informed the Court that his attorney is no longer representing him in this appeal. Appellant requests "more time to hire another lawyer."
In civil cases, a party is entitled to represent himself or to be represented by an attorney. Tex.R.Civ.P. 7. However, an appellant is not entitled to hybrid representation. See Posner v. Dallas Cty. Child Welfare Unit of Tex. Dep't of Human Servs., 784 S.W.2d 585, 587 (Tex. App-Eastland 1990, writ denied).
Because it is not clear whether attorney Chad Norcross continues to represent appellant, Chad Norcross is ORDERED to file, within TEN DAYS of the date of this order either (1) a motion to withdraw as counsel; or (2) written verification that he continues to represent appellant in this appeal.
If appellant has obtained new counsel, appellant is ORDERED to file, within THIRTY DAYS of the date of this order, the name and contact information for new counsel. If Mr. Norcross no longer represents appellant and appellant fails to provide the name and contact information for new counsel, the Court will proceed with appellant representing himself.
The deadline for filing appellant's brief is suspended pending a determination of who is representing appellant in this appeal.
The Clerk of the Court is directed to send a copy of this order to Chad A. Norcross, Samuel Obazee, Matthew E. Last, and Stephanie A. Roman.
