DECISION AND ORDER ON MOTION

Motion for stay pending appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, without costs, upon the condition that appellant's operation of trucks, excavators, loaders, grinders and other heavy equipment is restricted to the hours of 8 a.m. to 5 p.m., Monday through Friday. This motion is granted without prejudice to a motion by respondents to vacate the stay in the event that appellant fails to perfect the appeal on or before September 10, 2012 or fails to comply with the conditions set forth in this order.
