DECISION AND ORDER ON MOTION

Motion for modification and/or clarification of order.

Cross motion to vacate stay pending appeal.

Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is

ORDERED that the motion for clarification of this Court's order entered August 9, 2012 is granted, without costs, to the extent that the condition imposed in said order applies to all three parcels owned by appellant, and it is further

ORDERED that the motion for modification of this Court's order is denied, without costs, and it is further

ORDERED that the cross motion to vacate the stay is denied, without costs.
