ORDER

Christopher M. Murray, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction because the October 13, 2021 order is not a final order appealable of right. MCR 7.202(6)(a); MCR 7.203(A). Notably, while the claim of appeal states that it is taken from a September 27, 2021 order, the copy of the lower court register of actions provided with the claim of appeal has no entry for that date, and a copy of the October 13, 2021 order was provided with the claim of appeal. Thus, the claim of appeal must reasonably be considered as taken from the October 13, 2021 order. Dismissal is without prejudice to the filing of an application or delayed application for leave to appeal under MCR 7.205, provided such a filing meets all requirements under the court rules and is not time-barred.

The motion to waive fees is also DISMISSED as moot.
