ORDER ADOPTING REPORT AND RECOMMENDATION

The court has reviewed the Report and Recommendation ("R&R") of Magistrate Judge J. Richard Creatura (Dkt. # 30) and the remaining record. No objections were filed. (See Dkt.) Accordingly, the court does hereby find and ORDER:

(1) The R&R is ADOPTED;

(2) Defendant's motion to dismiss (Dkt. # 14) is GRANTED in part and DENIED in part. Plaintiff's claim under RCW 19.86.020 is dismissed with prejudice; and

(3) The Clerk shall send copies of this Order to counsel for the parties and to Magistrate Judge Creatura.
