NEIL L. NUNES, Petitioner, v. JAMES SALMONSEN, Warden, Montana State Prison, Respondent.

ORDER

Neil L. Nunes has filed a Petition for Writ of Habeas Corpus, asserting that the Teton County District Court lacked jurisdiction, which makes his incarceration illegal. He includes a copy of a pleading, titled "Supplement Brief."

This Court observes that Nunes has three appeals pending with this Court. He has counsel to represent him in his appeals. Nunes should refrain from filing pleadings on his own behalf with this Court when he is represented by counsel. M. R. App. P. 10(1)(c); State v. Samples, 2005 MT 210, ¶ 15, 328 Mont. 242, 119 P.3d 1191.

Without reaching the merits, we must dismiss his Petition. Therefore, IT IS ORDERED that Nunes's Petition for Writ of Habeas Corpus is DISMISSED.

IT IS FURTHER ORDERED that the Clerk of the Supreme Court is directed to CLOSE this matter as of this Order's date.

The Clerk also is directed to provide a copy of this Order to: counsel of record; Joe Coble, County Attorney; Cori Losing, Assistant Attorney General; Rufus I. Peace and Chad M. Wright, Appellate Defender Division; and Neil L. Nunes personally.
