Jonathan Bates NUNEMAKER, Appellant v. The STATE of Texas, Appellee

From the 454th Judicial District Court, Medina County, Texas Trial Court No. 23-07-14823-CR Honorable Daniel J. Kindred, Judge Presiding

ORDER

Beth Watkins, Justice

The clerk's record in this case shows that on July 2, 2024, the trial court denied appellant's motion for a free record. Accordingly, on July 19 and 23, 2024, we ordered appellant to present written proof that he had requested the preparation of the reporter's record in writing and that he had paid or made arrangements to pay the court reporters' fees to prepare the record.

In response to our orders, appellant notified this court that the trial court planned to hold a second hearing on his request for a free record. On August 16, 2024, the district clerk filed a supplemental clerk's record that contained an August 13, 2024 order denying appellant's request for a free record.

We ORDER appellant to file, by September 5, 2024, either: (1) written proof that he has requested and paid or made arrangements to pay for the preparation of the reporter's records; or (2) a motion challenging the trial court's orders denying his request for a free record. If appellant fails to respond to this order within the time provided, his brief will be due by September 25, 2024 and the court will consider only those issues or points raised in appellant's brief that do not require a reporter's record for a decision. See Tex. R. App. P. 37.3(c).

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 26th day of August, 2024.
