The reporter's record in this case is currently due August 14, 2024. On July 15, 2024, court reporter Sherry Gentry filed a notification of late record stating appellant has not requested the preparation of her volumes of the reporter's record in writing. Ms. Gentry further represented that appellant has not paid or made arrangements to pay Ms. Gentry's fee for preparing the record and is not entitled to appeal without paying the fee.
We ORDER appellant to provide written proof to this court by August 5, 2024 that:
(1) he has requested that Ms. Gentry prepare her volumes of the reporter's record, which request must designate the portions of the proceedings and the exhibits to be included. See TEX. R. APP. P. 34.6(b)(1); and
(2) he has paid or made arrangements to pay Ms. Gentry's fee to prepare her volumes of the record. See TEX. R. APP. P. 35.3(B)(3).
Ms. Gentry's volumes of the reporter's record must be filed no later than 30 days after the date appellant's written proof is filed with this court. If appellant fails to respond within the time provided, the court will consider only those issues or points raised in appellant's brief that do not require Ms. Gentry's volumes of the record for a decision. See TEX. R. APP. P. 37.3(C).
