This case is calendared for trial at the session of the Court to be conducted in person commencing Monday, October 17, 2022, in San Antonio, Texas.
On September 6, 2022, the petitioners filed a Motion for Continuance. In that motion, petitioners represented that they were unable to determine whether respondent objects to the granting of that motion. On September 22, 2022, the Court issued an Order directing respondent to file on or before September 26, 2022, a response to petitioners' Motion of Continuance filed on September 6, 2022.
On September 22, 2022, respondent filed a Status Report . In that report, respondent represented the respondent agrees a continuance would be appropriate in this case due to the availability of one of respondent's witnesses. Furthermore, as stated in respondent's Status Report, respondent has no objections to the granting of petitioners' Motion to Continuance and requests this case be restored to the general docket
Upon due consideration and for cause, it is
ORDERED that petitioners' Motion for Continuance filed September 6, 2022, is granted, and this case is stricken for trial from the October 17, 2022, in San Antonio, Texas, trial session and is continued generally.
