ORDER
Upon consideration of Appellant Jacek Nowicki's petition for reconsideration of appeal, which this court will deem a motion to reconsider dismissal of the appeal, the papers in support, and the records and files herein, it appears that Appellant asks this court for the following relief: (1) waiver of appellate filing fees; (2) waiver of any and all rules of appeal; and (3) allow oral presentation of arguments in place of written documents.
IT IS HEREBY ORDERED that the request for waiver of the appellate filing fees is granted, and the clerk of the court shall file the record on appeal without prepayment of the filing fees.
IT IS FURTHER ORDERED that the request to waive any and all rules of appeal is denied without prejudice to Appellant seeking an extension of time in accordance with Hawaii Rules of Appellate Procedure (HRAP) Rules 26 and 29 if he is unable to comply with the deadlines for filing his opening or reply brief. Appellant shall serve copies of all papers filed in this appeal in accordance with HRAP Rule 25.
IT IS FINALLY ORDERED that Appellant's request that he be allowed to present his case orally instead of filing written documents is denied without prejudice to the court setting the case for oral argument, if necessary, in accordance with HRAP Rule 34 after the parties file their written briefs in accordance with HRAP Rule 28.
