IN THE MATTER OF JULIO NOVA, PETITIONER, v. ANTHONY ANNUCCI, ACTING COMMISSIONER, NEW YORK STATE DEPARTMENT OF CORRECTIONS AND COMMUNITY SUPERVISION, RESPONDENT.


PRESENT:

Respondent having moved for permission to file an amended answer and for an extension of time for the parties to file and serve their briefs or, in the alternative, for an extension of time to file and serve a brief in this CPLR article 78 proceeding transferred to this Court by order of the Supreme Court, Wyoming County, entered August 12, 2020,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted insofar as it seeks leave to file an amended answer, on the condition that the amended answer is filed and served on or before January 15, 2021, and

It is further ORDERED that the motion is granted inasmuch as petitioner may file an amended brief in response to the amended answer on or before February 19, 2021, and

It is further ORDERED that the motion is granted inasmuch as respondent may file and serve a brief on or before March 26, 2021, and

It is further ORDERED that the proceeding is removed from the Court's day calendar for January, 11, 2021, and is added to the calendar for the term commencing April 6, 2021.
