ORDER

Under the E-Government Act of 2002, this is a written opinion and therefore is available electronically. However, it has been entered only to decide the motion or matter addressed herein and is not intended for official publication or to serve as precedent.


This case is before the Court on Plaintiff's Petition for Writ of Certiorari (Doc. 14) and Affidavit of Indigency (Doc. 15). To the extent plaintiff seeks further relief from this Court, his motions are denied as the Court has already dismissed plaintiff's claims with prejudice on grounds of res judicata (see Order, Doc. 13) and plaintiff has presented no basis upon which to revisit those rulings. To the extent plaintiff is attempting to seek leave to proceed in forma pauperis on appeal, such relief is also denied, as the Court finds that although plaintiff likely meets the financial requirements for proceeding in forma pauperis, the grounds for his appeal are frivolous within the meaning of 28 U.S.C. § 1915(e)(2)(B)(I). See Sun v. Forrester, 939 F.2d 924 (11th Cir. 1991) (defining a frivolous appeal in this Circuit as one which is "without arguable merit" either factually or legally).
